A PROBLEMÁTICA DAS SOCIEDADES MULTIDISCIPLINARES NA ÁREA DO DIREITO: O CASO DA ADVOCACIA PORTUGUESA

Abstract

A Lei n. 2/2013, de 10 de janeiro, que estabelece, na ordem interna portuguesa, o regime jurídico de criação, organização e funcionamento das associações públicas profissionais, põe fim à tradicional proibição de sociedades multidisciplinares, permitindo que especialistas inscritos em diferentes ordens profissionais (por exemplo, advogados e revisores oficiais de contas) possam constituir e integrar uma só estrutura societária. No entanto, o Estatuto da Ordem dos Advogados (EOA) ainda em vigor, aprovado pela Lei n. 15/2005, de 26 de janeiro, proíbe as também apelidadas sociedades pluridisciplinares. Considerando que o atual EOA se encontra, neste momento, em processo de revisão, importa analisar o tratamento legislativo que a matéria em apreço reclama, debruçando-nos sobre a opção que o legislador deve adotar nesta sede.

Abstract

Law No. 2/2013, of January 10, establishes on the Portuguese domestic law, the legal framework for the creation, organization and operation of professional public associations, and puts an end to the traditional prohibition of multidisciplinary societies, allowing expert members of various professional associations (for example lawyers and auditors) to constitute and integrate a single societal structure. However, the Statute of the Bar Association (EOA), still in effect, approved by Law No. 15/2005, of 26 January, prohibits these also dubbed multidisciplinary societies. Whereas the current EOA is, at present, under review, it is important to examine the  legislative treatment the matter under consideration demands, addressing the option that the legislator should adopt in this subject.
